Terms of Service – Nyumbani

By using Nyumbani, you agree to the following terms:

1. Account Responsibility

You are responsible for providing accurate and complete information when creating or updating your Nyumbani account. You must keep your login credentials, including passwords and authentication methods, secure and confidential. Any activity performed through your account is your responsibility, including actions taken by anyone who gains access to your account with or without your permission.

2. Permitted Use

Nyumbani may only be used for lawful purposes directly related to property management, tenancy, utility, and billing services. You agree not to use the platform for any illegal activity, fraudulent purposes, or to interfere with the operation of Nyumbani or its services.

3. Billing and Payments

Payments processed through Nyumbani are subject to applicable billing rules, service charges, and payment terms set by property owners, managers, or third-party payment providers. Nyumbani acts as a facilitator for these transactions and is not responsible for disputes regarding amounts, payment schedules, or external payment processor errors.

4. Communication Services

Nyumbani may send notifications and alerts via SMS, WhatsApp, email, or in-app messaging to keep you informed about your account, billing, tenancy status, or service updates. By using Nyumbani, you consent to receive these communications. You may adjust certain notification preferences where applicable within your account settings.

5. Limitation of Liability

Nyumbani Tech Solutions Limited is not liable for:

  • Losses or damages resulting from incorrect or incomplete information provided by users

  • Service interruptions due to network failures, third-party outages, or technical issues

  • Disputes, claims, or legal issues between landlords, tenants, or other users

  • Any indirect, incidental, or consequential damages arising from the use of the platform

To the maximum extent permitted by law, the total liability of Nyumbani for any claims related to the platform is limited to the fees, if any, paid by you to Nyumbani in the preceding 12 months.

6. Modifications

Nyumbani may update or modify these Terms of Use at any time. Continued use of the platform after changes have been made constitutes your acceptance of the updated terms. We encourage you to review the Terms periodically to stay informed about any updates.

7. Termination

We reserve the right to suspend or terminate your account if:

  • You violate these Terms of Use or applicable laws

  • Your actions interfere with the integrity or operation of Nyumbani

  • We are required to do so to comply with legal obligations

Upon termination, your access to Nyumbani will cease. Certain data may be retained as required by law, regulatory obligations, or for accounting purposes.

8. Intellectual Property

All content, software, branding, and materials provided on Nyumbani are the property of Nyumbani Tech Solutions Limited or its licensors. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the platform without prior written permission, except for personal or internal use in connection with the services.

9. Privacy

Your use of Nyumbani is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal information. By using Nyumbani, you consent to the practices described in the Privacy Policy.

10. Dispute Resolution

These Terms of Use are governed by the laws of Kenya. Any disputes arising from your use of Nyumbani shall first be attempted to be resolved through good faith negotiation. If a resolution cannot be reached, disputes may be submitted to binding arbitration or the courts of competent jurisdiction in Kenya.

11. User Conduct

You agree not to:

  • Use Nyumbani to harass, threaten, or harm other users

  • Access or attempt to access accounts without authorization

  • Introduce viruses, malware, or harmful code into the platform

  • Use automated tools or scraping techniques to extract data without permission

Failure to comply with these rules may result in suspension or termination of your account.
